House and Car Park Rules
Welcome to Topgolf Wien! We wish you lots of fun and enjoyment during your stay with us. However, we would like to draw your attention to a few rules and points of conduct that apply to the entire Topgolf site (including the car park). We ask you to always act with care and consideration. Above all, this means taking responsibility for yourself and for other visitors and observing the rules of courtesy. We also ask you to follow the rules below closely for the duration of your stay at Topgolf.
1. Parking
1.1 The rules and signs of the Austrian Road Traffic Regulations (StVO) apply in our car parks.
1.2 To keep traffic flowing without disruption, the instructions of our staff in the car parks must be strictly observed. Only park your vehicle in the designated parking spaces. If you do not park your vehicle properly and traffic is obstructed as a result, we will be forced to have the vehicle towed away at your expense and risk.
1.3 The areas intended for parking are not supervised by Topgolf Wien. When leaving your vehicle, please make sure that doors, boot, windows and sunroof are closed. In your own interest, you are also asked not to leave any valuables visible in the car. Likewise, no animals may be left in the vehicle.
1.4 Topgolf Wien is not liable for theft of or damage to your vehicle by third parties. This also applies to damage caused by storm, fire, hail, explosion and other extraordinary events. Any damage that you believe to have been caused by our staff must be reported to our staff immediately after it is discovered and, if possible, during the visit, insofar as this is reasonable. Topgolf Wien is, however, only liable for any fault of its staff in cases of intent or gross negligence.
1.5 The consumption of alcoholic beverages you have brought with you is prohibited in the car parks.
2. General safety regulations
2.1 The instructions of Topgolf staff must always be followed, in your own interest.
2.2 All guests are required to behave correctly and appropriately. Disturbance of public order, wilful destruction or soiling, improper behaviour, interference with other guests or with operations, use of verbal or physical violence, insults, abuse, disregard of the house rules etc. will prompt us to take appropriate measures such as expulsion from the premises, filing a report with the police or similar. Topgolf Wien also reserves the right to remove from the premises, without compensation, guests whose behaviour suggests that they could endanger or disturb themselves or other persons.
2.3 Possessing and carrying weapons, imitation weapons or dangerous objects such as firearms, sharp or pointed knives, chains, knuckledusters, stun guns, tools, large scissors, wires, crossbows, bows and arrows, blowpipes, slingshots, baseball bats, fireworks or other pyrotechnic articles, as well as any kind of discriminatory, violence-glorifying or anti-constitutional objects etc., is not permitted on the premises of Topgolf Wien.
2.4 Bringing or operating drones or any kind of remote-controlled toys and devices is not permitted.
2.5 Wilful noise and the loud operation of music devices are prohibited. Objects that may disturb the public peace, such as vuvuzelas, megaphones, horns or other musical instruments, may not be brought along or used.
2.6 The fire safety regulations on the premises must be strictly observed. Smoking in the building and on the teeline is prohibited.
2.7 Guests are strictly prohibited from walking on the artificial turf.
2.8 Weather conditions (rain, freezing rain, natural snowfall or similar) may create a risk of slipping. Guests are therefore advised to exercise the necessary caution and care throughout the site, i.e. to observe barriers, wear non-slip footwear and refrain from walking fast and running.
2.9 All guests are required to dress correctly and appropriately. Tops and shoes must be worn.
2.10 Dogs may be brought into the building at Topgolf Wien. However, they are not allowed on the teeline (the entire playing area) for safety reasons.
2.11 Bringing alcohol, and the possession or consumption of illegal narcotics and of aids for their consumption, is prohibited and will be dealt with accordingly. This also applies to bringing medicinal cannabis products that are suitable for consumption by smoking, unless their possession and the need to carry them are proven by a doctor's prescription.
2.12 Searching through waste, collection or catchment containers is prohibited. The contents of the containers provided for this purpose are the property of Topgolf Wien. Any removal of them from the premises is prohibited.
2.13 Persons under the influence of drugs or medication, or heavily intoxicated persons, will be denied (further) access to the Topgolf venue. The final decision lies with the responsible Topgolf manager on site, who is authorised to decide on behalf of the managing director.
2.14 The client confirms that all participants are physically and mentally able to play Topgolf.
3. Use of the facility & rules of play
3.1 The opening hours stated on the website may vary on exceptional occasions.
3.2 Please stay within the marked area while playing and do not step over the yellow line.
3.3 In the event of technical faults (most common fault: no ball is dispensed), please contact the staff immediately.
3.4 Only Topgolf balls may be used for hitting. Playing with your own balls is not permitted.
3.5 Using your own golf equipment is permitted and is at your own risk. Topgolf Wien accepts no liability for any damage.
3.6 In the event of strong winds, thunderstorms or special weather conditions, Topgolf Wien is entitled to suspend the operation of individual bays or of the entire venue in order to protect guests. There is no entitlement to a full or partial refund.
3.7 Technical or organisational outages of individual areas or games do not give rise to any right to a reduction or refund of the game price.
3.8 Guests are obliged to satisfy themselves of their own state of health before use, to inform themselves about risks, and to take note of and comply with the rules of use and access as well as the safety rules and regulations. Exclusion for safety reasons does not constitute discrimination; it solely serves to protect your health and your own safety.
3.9 The bays are used at your own risk.
3.10 Please do not leave your valuables unattended. No liability is accepted for the loss of any items.
In times of pandemics or other special situations, you are obliged to comply with the applicable legal and official regulations, such as mask requirements or distancing rules. If you do not adhere to these regulations as communicated by us or our staff, we reserve the right to exercise our right to refuse admission.
4. Reservation
4.1 The booked bay (hitting bay) is available to the guest on the day of play at the booked time. Extending the playing time is possible subject to availability at the applicable rates.
4.2 For reservations, we ask you to arrive 15 minutes before the start of play and report to reception. The reservation lapses if you are more than 15 minutes late for the start time.
4.3 Every guest undertakes to keep to the reservation times. This also applies in the event of any operational disruptions. Extending or postponing the time is not possible if the bay is already booked afterwards.
4.4 Once the playing time has expired or there is a fault, no further balls may be hit.
4.5 There is no entitlement to a specific bay, but we will try to meet requests for specific bays wherever possible.
5. Prices
5.1 All prices are in euros, including VAT.
5.2 The bill for gameplay, food and drinks is to be settled with the service staff at the end of the playing time.
5.3 Topgolf Wien accepts the following cards: Eurocard, Visa, American Express and EC.
5.4 Topgolf Wien gift vouchers can be redeemed for playing time, food, drinks and retail items. They are valid for 5 years from purchase.
5.5 Topgolf Wien reserves the right to adjust all gross prices proportionately in the event of statutory changes to VAT rates.
6. Events
6.1 Our quotes are generally valid for 7 days.
6.2 Services and costs are defined in advance with the client and invoiced following the client's written confirmation.
6.3 Topgolf undertakes to maintain confidentiality towards third parties regarding content, order value and/or matters (company knowledge) that it learns of in the course of the engagement.
6.4 The client undertakes to communicate without delay any changes or news relevant to the delivery of the event (in particular concept, planning, organisation, support etc.). Notification must be made in writing. Change requests must be communicated at least 14 days before the start of the event.
6.5 For an order value of more than €10,000, 50% is due 14 days before the start of the event.
6.6 Unless otherwise agreed, invoice amounts are payable within 14 days of receipt of the invoice, without deduction. In the event of late payment, Topgolf Wien is entitled to charge reminder fees and default interest.
6.7 The event can be cancelled free of charge up to 14 days before the start of the event; after that it will be charged in full in accordance with the event contract.
6.8 A change in the number of participants does not automatically mean a proportional change in the price.
6.9 Persons under the influence of drugs or medication, or heavily intoxicated persons, will be denied (further) access to the Topgolf venue. The final decision lies with the responsible Topgolf manager on site, who is authorised to decide on behalf of the managing director.
6.10 In the event of bad weather, there is no entitlement to a refund or reduction of the invoice amount.
6.11 By signing, the client confirms that all participants are physically and mentally able to play Topgolf.
6.12 Topgolf Wien accepts no liability for damage caused by measures taken to maintain public safety and order. No liability is accepted for items brought into the event rooms by the organiser or by third parties. Guests themselves are liable for damage, theft or heavy soiling of any kind caused by guests in our venue or on our property.
6.13 Quotes and orders from Topgolf Wien are prepared on the basis of the applicable VAT rates. If VAT rates change before the service is provided, we reserve the right to adjust the gross prices proportionately.
7. Duty of supervision
Parents and accompanying persons are reminded that they must carefully fulfil their duty of supervision. They also bear responsibility for all damage caused by those in their care, even if the supervising person is not present on site on the day of the visit.
8. Advertising and offering of goods and services
Advertising on the premises and in the car parks of Topgolf Wien, or the offering of goods and services, is only permitted with the prior written approval of the management. This also applies to conducting opinion polls and counts. Advertising and announcements for organisations, associations, interest groups or personal causes by any means whatsoever are prohibited on the premises and will in each individual case be met with expulsion, civil claims and a criminal complaint for trespass.
9. Video surveillance
9.1 The entire Topgolf Wien venue is under video surveillance. The surveillance serves the safety of guests and staff as well as the protection of the venue and its facilities.
9.2 Where film and photo recordings are made at Topgolf Wien for television programmes, advertising or other purposes, the relevant areas are marked accordingly or this is readily apparent. Every visitor is free to avoid these areas while the recordings are being made.
9.3 Taking your own photos and videos for private purposes is permitted, provided other guests are not affected or disturbed by this. Professional photo and film recordings intended for commercial use, however, are only permitted with prior written approval from the marketing department or directly from the management.
10. Limitation of liability
10.1 Topgolf Wien is liable for all damage caused by culpable breach of a material contractual obligation by Topgolf Wien or Topgolf staff, or attributable to gross negligence or intent.
10.2 In the event of a breach of a material contractual obligation, liability in cases of simple negligence is limited to the foreseeable damage typical for the contract.
10.3 Liability for injury to life, body or health, liability under the Product Liability Act, liability for fraudulently concealed defects and liability where a guarantee for the quality of an item has been assumed remain unaffected.
10.4 Topgolf Wien is not liable for items placed or deposited on the premises. No liability is accepted for items (for example mobile phones, jewellery, cameras, clothing etc.) that are damaged, destroyed or lost during the stay.
11. Reporting damage
All facilities are carefully maintained and monitored. Should you nevertheless suffer damage through no fault of your own, please report it to a member of staff before leaving the premises. Please also get in touch if there is reason to believe that an incident might lead to damage at a later point.
12. Right to refuse admission
Topgolf Wien is entitled, at its own discretion, to remove persons who violate the house and car park rules from the premises without compensation.
